New York-Presbyterian/Brooklyn Methodist Hospital agreed Tuesday to a $17. 3 million settlement to respond to allegations of health care fraud. U. S. Attorney for the Eastern District of New York, Breon Peace, announced that the settlement addresses claims similar to illegal bribes paid to doctors at the hospital’s chemotherapy infusion center.
The allegations relate to a contractual agreement that would tie doctors’ remuneration to the volume of referrals made for the center’s services. The settlement resolves allegations that doctors at the infusion center failed to properly supervise chemotherapy services, a violation of federal and New York State law. about false claims.
The hospital agreed to pay $16. 41 billion to the federal government and $890,000 to New York state, following a voluntary disclosure of the information through the hospital itself.
“This agreement is about a payment plan that incentivized doctors to consult based on the amount they would be paid and that were necessarily bribes,” said U. S. Attorney Breon Peace. “New York Presbyterian/Brooklyn Methodist Hospital voluntarily disclosed its habit to the United States, which enabled it to mitigate the consequences related to that habit. “
The regulation includes strict enforcement of Medicare and Medicaid regulations designed to prevent monetary incentives from influencing patient care decisions. These regulations explicitly prohibit remuneration for patient referrals so that medical decisions prioritize patients’ wishes over monetary gains.
The regulations also require direct involvement and oversight of physicians who bill for what is provided to patients.
