Trump warned him that defying the subpoena to MAL would be a crime

A lot has happened. Here are some of the things. This is TPM’s Morning Memo. Sign up for the release.

Jennifer Little, Trump’s former lawyer, told special counsel Jack Smith that she warned Trump that if he complied with a federal grand jury subpoena for all classified documents at Mar-a-Lago, it would be a crime, according to a new report. . from ABC News.

Sources said attorney Jennifer Little told investigators that Trump “absolutely” understood the warning, which came at a very important meeting at Mar-a-Lago with Trump and another lawyer, Evan Corcoran, who had recently joined Trump’s legal team.

The subpoena comes after months of requests from the National Archives for Trump to return government documents he took from the White House to Mar-a-Lago. Little said he wants Trump to perceive that a grand jury subpoena is another and more serious. “You have to comply,” she reportedly warned.

Once again, those are the alleged words of Trump’s own lawyer. Little and Trump attorney Evan Corcoran were forced to testify before the grand jury after U. S. District Judge Beryl A. Howell ruled that the attorney-client privilege did not apply because their legal recommendation had been used to dedicate to a crime.

It appears that the D. C. Circuit Court of Appeals He inadvertently opened a record he shouldn’t have. This happened in the case of Rep. Scott Perry’s phone, which was seized through the FBI in August 2022. Months of litigation followed over whether Perry, a Republican from Pennsylvania, approved the speech or debate clause of the Constitution, and Perry won a partial victory. But a significant victory when he appealed the case. The documents were sealed, but were briefly opened Wednesday afternoon, then resealed and hidden from the public later that night.

Politico’s Kyle Cheney takes a look at what documents inadvertently revealed about Perry’s communications between Election Day 2022 and Jan. 6, 2021, show.

Two supervisors in Cochise County, Arizona, have been criminally charged through the state’s attorney for refusing to certify the effects of the 2022 election.

Henry Kissinger’s Memories:

The name says it all: “Tucker Carlson, Trump’s shadow diplomat. “

I can’t speak to the broader geopolitical implications, but in terms of espionage mystery, India’s alleged plot to assassinate a Sikh separatist in New York City is exhilarating. . . and comical.

It’s probably less difficult to separate what’s genuine from what’s police subterfuge, as the new federal indictment claims:

REAL:

Nikhil Gupta, the accused of acting as an intermediary between Indian intelligence and would-be assassins

Gurpatwant Singh Pannun, the victim, whose name is not listed in the indictment but fits the description of a virulent Sikh critic of India in New York.

Anonymous Indian officer who claimed to have worked in intelligence and recruited Gupta in the plot to assassinate Pannun.

SUBTERFUGE:

The confidential source, an anonymous “criminal associate” whom Gupta contacted to hire a hitman, but who turned out to be a U. S. government informant.

The hitman, who turned out to be an undercover U.S. law enforcement officer

As you can see, it started as an assassination plot and ended with a trap. And, man, do you have the receipts: communications, photographs, and videos while it was all going on, with Gupta tricked into thinking he was dealing with some bad actors.

As funny as it may seem, the stakes were real. As this case unfolded, the alleged Indian murder plot on Canadian soil took hold and was even discussed in communications between Gupta and his Indian teacher.

In two separate in-person conversations reported via WaPo, Rep. Kevin McCarthy (R-CA) claims to have said “Fuck you” to Donald Trump after his ouster as president last month. McCarthy’s workplace now denies swearing.

Politician: “Johnson has deeply irritated conservatives by engaging in political discussions with other leaders, rather than pushing exclusively for victories that please the base and that might not make it in the Senate. This classic technique probably wouldn’t hurt Johnson with the majority of House Republicans; However, as McCarthy’s overthrow made clear, it only takes a handful of tired members to make life difficult for a president.
