Germany struggles to manage iGaming with new state gambling treaty

Online gambling in Germany has been a hotly debated topic for years, as the country’s 16 states offer different perspectives on the many facets of Internet gambling legislation, and this debate continues as the country continues to move forward with a new online gambling framework.

Following the adoption of the State Treaty for the new regulation of games through German legislators before this year, the proposed new law is expected to enter into force in July 2021, pending a series of approvals and ratifications, approved by the European Commission.

But since even if all goes well, the new law will not take effect for some other year, in the meantime many questions have been asked about how the game will be controlled.

Perhaps the biggest question is how to approach international online gaming operators that are licensed by other EU states and are currently offering services to people within Germany (which is permitted under EU law).

Some facets of the state treaty for the new regulation of gambling that require a more restrictive habit than that recently practiced through operators, lawmakers disagree with how corporations that accept German players are considered to be when applying for a license under the new law.

Suggestions on how corporations that are lately offering bets in Germany and will try to continue to do so in the new framework to come in 2021 deserve to continue this transition period, ranging from a general blackout to forgiveness.

The online gaming giant bet365 has chosen to withdraw its online casino games from the German market until the end of 2019, in the hope that such action will bode well for its aspirations to obtain a licence under the new framework, but there is no consensus among German declares whether such a pause is necessary.

Some German states see the scenario differently, with the reasoning that the market in its current state can be considered grey, and that as long as operators adhere to the rules and restrictions set out in the draft State Treaty that will come into force next year, they are necessarily acting on a smart religion and their operations deserve to be tolerated during the transition period.

Under the new law, a deposit restriction of 1000 euros consistent with the month will be implemented in all vertical sectors of igaming as a form of player protection. In addition, slots will be restricted to $1 and in-game bets will sometimes be prohibited.

The law would also impose restrictions on how online games can be promoted, with a ban on matching the day’s advertising.

Affiliated sellers will also face some restrictions. Although online casino valuation sites are permitted, agreements that affiliates have with operators will not be able to come with a refund based on profit sharing.

If everything continues in its current course and the State Treaty for the New Regulation on Gaming is approved through the EU and ratified through the states, the law will be in force until 31 December 2028.
