Six judges necessarily rewrote Title VII, the federal law that prohibits discrimination on the basis of sex on employment, to now prohibit discrimination on the basis of sexual orientation or gender identity.
It is difficult to argue that what the Court did reflects what the public understood meant the law in 196 or in time since.
